1. General provisions
These purchase and sale rules (hereinafter – the Rules) determine the mutual rights, duties and responsibilities of the person who purchases goods in this electronic store (hereinafter – the Buyer), the owner of the electronic store (hereinafter – the seller), when the Buyer purchases goods in the electronic store. By purchasing goods in the online store, the Buyer agrees to the application of these Rules.
2. The moment of conclusion of the purchase and sale contract
2.1. The purchase and sale agreement between the Buyer and the Seller is considered concluded from the moment the Buyer creates a shopping cart in the electronic store, specifies the delivery address, selects the payment method and clicks the “Pay now” button and is valid until the full fulfillment of the obligations under this agreement. In cases where the Buyer does not agree with all or a certain part of the Rules, he must not place the order.
2.2. Each contract concluded between the Buyer and the Seller is stored in the database of the electronic store.
3. Buyer’s rights
3.1. The buyer has the right to buy goods in the electronic store in accordance with these Rules and other legal acts in force in the country.
3.2. The buyer (user) has the right to refuse the contract for the purchase and sale of goods concluded in the electronic store with the Seller (except for the contract for the sale of audio and video works and phonograms on any video or audio media, computer programs, if the buyer (user) has violated the protection of the packaging; newspapers, magazines or the sale of other periodicals), by notifying the Seller in writing within 7 working days from the day of delivery of the goods. The buyer has the right to withdraw from the contract for the purchase and sale of goods with the seller only if the goods are of high quality, have not been damaged and have not substantially changed their appearance.
3.3. The buyer has other rights provided for in the Rules and state legislation.
3.4. A buyer who thinks he was his rights have been violated, he must contact the Seller in writing no later than three months from the day of the violation and state your requirements. The seller must examine the request free of charge within 14 days at the latest and provide a detailed reasoned written answer based on documents. If the problem cannot be solved, The buyer has the right to apply to an entity that resolves consumer disputes out of court or to a court
3.5. The buyer can submit requests or complaints on the electronic consumer dispute resolution platform http://ec.europa.eu/odr/.
4. Responsibilities of the buyer
4.1. The buyer must pay the price of the goods and their delivery, as well as other payments (if specified when concluding the contract) and accept the ordered goods. The Buyer pays for the goods by paying through Stripe, Opay, bank transfer or PayPal system.
4.2. If the data provided in the Buyer’s registration form changes, the Buyer must update them immediately.
4.3. The buyer must comply with other Terms and Conditions and other requirements of international law
5. Seller’s Rights
5.1. If the Buyer tries to harm the work or stable operation of the electronic store or violates his obligations, the Seller can limit, suspend (terminate) his access to the electronic store without prior warning and is not responsible for any related losses of the Buyer.
5.2. The Seller has the right to temporarily or indefinitely terminate the operation of the electronic store without separate notice and is not responsible for any related losses of the Buyer.
5.3. The seller has the right to unilaterally change these Rules by publishing the changed Rules on the website of the electronic store. Changes take effect from the moment of publication for all transactions concluded after publication.
6. Responsibilities of the seller
Delivery guarantee
We offer an additional flawless delivery guarantee that can be claimed within 24 hours of receiving the product. If products have been damaged in transit or do not match your order, please notify us of the error within 24 hours of delivery. Email us a letter with a photo of the package (the label must also be clearly visible in the photo) and a photo of the received product showing the damaged area clearly. We will prioritize processing your claim in the shortest possible time and provide you with a replacement product. If a claim is sent too late, it will be treated as a product complaint. Warranty for technical products The warranty can only be applied to technical products and electrical appliances offered by us. According to the Law on the Protection of Consumer Rights, you can use the warranty on the basis of an invoice, which also serves as a warranty certificate. The buyer reserves the right to refuse to provide the warranty if the invoice is not submitted with the claim or if the invoice is illegible or something is missing.
The warranty does not apply if:
• the product is physically damaged;
• the product shows signs of wear due to normal use;
• the product has defects that have resulted from incorrect, inappropriate or careless use of the product.
Products for which you wish to use the warranty must be inspected, so please provide photos or videos of the defect with the warranty claim. If necessary, we will also ask you to send us the product so that we can check it. If we approve your warranty claim, we will send you a new product. You also have the right to request that your product be repaired, but you should be aware that the repair period is longer than the delivery period of a new product. If the repair takes more than 45 days, your product will be replaced with a new product. If we cannot offer a new product, we will refund the full purchase price of the product. 1. Complaint about product defects
2. If the product does not work properly, please email us. Email info@allroundoutlet.com and we will assist you with the necessary information. This will prevent possible misuse of the product and damage to the product itself, as well as injury to yourself or others.
3. If the product does not work, you can file a complaint and indicate the defects of the product. Cases that are considered essential product defects are specified in Chapter 7 of these Purchase and Sale Rules. You only have the right to complain about material defects if these defects already existed at the time of purchase, but were only noticed later.
4. If the product does not work due to a major defect, please report the defect immediately upon noticing it, but in no case later than two months from the date of noticing the defect. Email us a letter with a photo or video of the defective product, from which it can be determined beyond doubt that the product is not working. If necessary, we will also ask you to send us this product so that we can examine it and identify a product defect.
5. We will not be able to deal with your complaint for products that have been damaged due to improper or improper handling or use that is not necessary to determine the nature, characteristics and performance of the products. If, after your complaint has been rejected, you wish to have the product in question returned to you, we will send it back to you and issue you an invoice to cover the costs associated with the delivery of said product.
6. If you are applying for a material defect, you can use the following options: • product replacement, • refund, • product defect correction or • refund of a certain amount of money.
7. Return of goods
7.1. The user has the right to withdraw from the contract concluded online (in other words, to return a quality product) within 14 days without giving a reason.
7.1.1. Return costs are the responsibility of the buyer
7.1.2. The Buyer is responsible for the proper assembly and packaging of the returned goods. If the product is not complete and/or properly packed, the Seller does not accept the returned product.
7.1.3. Goods cannot be returned if they have been used and/or have been damaged and/or have lost their marketable appearance.
7.1.4. The money is returned to the buyer within 10 working days after the return is made
8. Liability
8.1. The buyer is responsible for the correctness of the data provided in the registration form. The buyer assumes responsibility for the consequences arising from the incorrectness or inaccuracy of the data provided in the registration form.
8.2. The parties are responsible for the violation of the purchase and sale contract concluded using the electronic store in accordance with the procedure established by state legislation.
8.3. The Seller is not responsible for the information provided on the websites of other companies, even if the Buyer accesses these websites through the links in the Seller’s electronic store.
8.4. The seller is not responsible for the fact that the color, shape or other parameters of the goods displayed in the online store do not correspond to the real size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.
8.6. In the event of damage, the guilty party compensates the other party for the direct losses incurred due to its fault.
9. Processing of personal data
9.1. By pressing the “Place order” or “Pay” button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agree to provide the Seller with his personal data specified in these rules and the registration form and does not object to the data provided by the Buyer and/or his representatives personal data would be processed by the Seller for the purpose of online shopping.
9.2. By pressing the “Place order” or “Pay” button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agree that the personal data provided by the Buyer and/or his representatives will be provided to the Seller’s chosen to third parties to process them for the purpose of online shopping, as discussed in the next point.
9.3. By clicking the “Place order” or “Pay” button, the Buyer confirms that he and his representatives (the Buyer has the consent of his representatives) agree to provide the Seller and/or the third person who delivered the goods on the Seller’s instructions, one of the personal identifiers when picking up the goods at the place of collection documents: passport, personal identity card, new model driver’s license, in order to properly identify the Buyer and/or his representatives for the purpose of online shopping. The Buyer also confirms that he and his representatives (the Buyer has the consent of his representatives) agree that during the collection of the goods, at the place of collection of the goods, the Seller and/or the third person who delivered the goods on the Seller’s instructions will sign the personal identification provided by the Buyer and/or his representative document data and would process this data (including but not limited to the transfer of data to the Seller) for the purpose of online trading.
9.4. By pressing the “Place order” or “Pay” button, the Buyer confirms that he (if the Buyer is a natural person) and his representatives are informed of their right to access their personal data processed by the Seller and how they are processed, demand correction, destruction of their personal data data or to stop the processing of their personal data when the data is processed in violation of the provisions of the law, to object to the processing of their personal data for any of the purposes.
9.5. By pressing the “Place order” or “Pay” button, the Buyer confirms that he and his representatives know that they have the right to refuse to provide their personal data, but understand that personal data are necessary and necessary in order to unambiguously identify the Buyer and/or his representatives in online shopping purposes and without providing personal data and/or not consenting to their processing for the purpose of online shopping, will not be able to enter into and/or execute a contract.
10. Sending information
10.1. The Seller sends all notifications to the e-mail address provided in the Buyer’s registration form.
10.2. The Buyer sends all messages and questions to the address specified in the “Contacts” section of the Seller’s e-store.
11. Final provisions
11.1. The Buyer and the Seller agree that all information that is provided on the Seller’s online store website (including, but not limited to, these Rules, information about the Seller, the offered goods and services and their characteristics, the Buyer’s right to refuse the purchase and sale contract implementation procedure, the Seller’s product maintenance services and guarantees (if they are provided)) are considered to be provided to the Buyer in writing.
11.2. These Rules do not limit the Buyer’s (user’s) rights established by state legislation.
11.3. All disputes arising out of or related to the purchase and sale agreement between the Buyer and the Seller shall be resolved by negotiation. If an agreement cannot be reached, disagreements are resolved according to the procedure established by legal acts.
